Other times the facts of the case reveal that the defendant acted only in fear of his or her own life, and a self-defense case can be developed. “Heat of passion” presents only a partial defense – because the defendant would still be guilty of Manslaughter – but this can reduce the possible sentence from the possibility of life in prison to only 1-10 years. The possible availability of any of these defenses – even if not ultimately successful – can often provide the opening that our lawyers need to work out a favorable plea bargain with the prosecutor.
